Terms of Service
These Terms of Service ("Terms") govern your use of the Dr. PlantCare mobile application and related services (the "App"), operated by Trial and Error, Inc. ("Dr. PlantCare," "we," "us"). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old (or 16 in the EEA / UK) to use the App. By using it, you confirm you meet this requirement and have the legal capacity to enter into these Terms.
2. Your account
Some features require an account, which you create by signing in with Apple or Google. You are responsible for keeping your credentials secure and for activity that occurs under your account. Notify us at support@drplantcare.com if you believe your account has been compromised.
3. Acceptable use
You agree not to:
- Use the App for unlawful purposes or in violation of these Terms.
- Upload content that infringes others' rights, or that is illegal, harmful, or misleading.
- Attempt to reverse engineer, decompile, scrape, or extract the App's source code or data.
- Interfere with the App's operation, bypass rate limits, or attack our infrastructure.
- Resell, sublicense, or otherwise commercialize the App without our written permission.
4. Your content
You keep ownership of photos and other content you submit ("Your Content"). You grant us a worldwide, royalty-free license to host, process, display, and transmit Your Content to operate the App — including sending it to our AI provider for plant identification and diagnosis. This license ends when you delete the content or your account, subject to reasonable backup retention.
5. Our intellectual property
The App, its design, code, branding, and AI-generated responses you receive are owned by Trial and Error, Inc. or our licensors and are protected by copyright, trademark, and other laws. We grant you a limited, revocable, non-transferable license to use the App for personal, non-commercial purposes.
6. Subscriptions and payment
Dr. PlantCare offers a free tier and a paid "Dr. PlantCare Premium" subscription with monthly and annual plans. Subscriptions are sold and processed exclusively through Apple's App Store.
- Payment is charged to your Apple ID at confirmation of purchase.
- Your subscription automatically renews for the same period (monthly or annual) at the then-current price unless you cancel at least 24 hours before the end of the current period.
- Your Apple ID will be charged for renewal within 24 hours prior to the end of the current period.
- You can manage and cancel your subscription by going to your Apple ID account settings on your device after purchase: Settings → [your name] → Subscriptions → Dr. PlantCare. See support.apple.com/HT202039.
- Any unused portion of a free trial (if offered) is forfeited when you purchase a subscription.
- Prices are shown in the App before purchase. Local taxes may apply.
7. Refunds
All payments are processed by Apple. We, as the developer, cannot issue refunds. Refund requests must be submitted to Apple at reportaproblem.apple.com. Refunds are granted at Apple's discretion under their Media Services Terms. See our Refund Policy for details.
8. Plant care disclaimer
Dr. PlantCare provides informational plant-care suggestions generated by AI. The App is not a substitute for professional advice from a qualified horticulturist, arborist, or veterinarian. AI responses can be incomplete or incorrect. You are responsible for decisions you make about your plants, pets, and environment. Always consult a professional for serious plant health concerns, for children, or for pets that may have ingested a toxic plant.
9. No medical or veterinary advice
Pet toxicity warnings in the App are informational only. If you believe your pet has been poisoned, contact the ASPCA Animal Poison Control Center at +1 (888) 426-4435 or your local veterinarian immediately.
10. Third-party services
The App relies on third-party services (Apple, Google, Cloudflare, RevenueCat, Expo). Your use of those services is governed by their own terms and privacy policies. We are not responsible for third-party services.
11. Termination
You may stop using the App at any time and delete your account from Profile → Delete Account. We may suspend or terminate your access if you violate these Terms, create risk or legal exposure for us, or if we discontinue the App. Sections that by their nature should survive (ownership, disclaimers, limitation of liability, dispute resolution) will survive termination.
12. Disclaimer of warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT AI OUTPUTS WILL BE ACCURATE.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRIAL AND ERROR, INC. WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR LOST PROFITS, LOST DATA, OR DAMAGE TO PLANTS, PETS, OR PROPERTY ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM OR (B) US$50.
14. Indemnification
You agree to indemnify and hold Trial and Error, Inc. harmless from any claims arising out of your use of the App, your content, or your violation of these Terms, to the extent permitted by law.
15. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction there. If you are a consumer in the EEA or UK, nothing here overrides mandatory consumer-protection rights in your country.
16. Apple-specific terms
You acknowledge that these Terms are between you and Trial and Error, Inc., not Apple. Apple is not responsible for the App or its content. In the event of non-conformity with any applicable warranty, you may notify Apple and Apple will refund the purchase price. Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Changes to these Terms
We may update these Terms from time to time. If changes are material we will notify you in the App or by email. Continued use after changes take effect means you accept the updated Terms.
